Overview
David Hutchinson represents a broad mix of business clients in a variety of litigation and transactional matters, with a particular emphasis on construction and real estate. He has represented institutional lenders, industrial, commercial and residential builders, architects, engineers, contractors, real estate management companies and a variety of individual and business clients. David effectively uses his experience in the litigation context to help his transactional clients avoid the situations that often lead to litigation. Likewise, his transactional experience provides uniquely valuable expertise when he litigates issues that arise from transactional settings.
David’s litigation experience includes trials before judges and juries in Colorado district and county courts, as well as in the U.S. District Court and U.S. Bankruptcy Court. He has handled appeals in the Colorado and federal appellate courts. David is also experienced in alternative dispute resolution processes, including arbitration and mediation.
Recognizing the danger that litigation expense can often become disproportionate to the economic stakes of a particular case, David strives in every matter to maximize efficiency without compromising effectiveness. Working closely with clients, he attempts at the earliest possible stage of each case to identify the themes that would be most effective at trial. By focusing on the storyline at the front end of his cases, David can then tailor his discovery and motion practice around the central case themes. His objective is to expend clients’ resources on the issues that are likely to make a significant impact at trial or in settlement negotiations, and to avoid the time and expense associated with the tangential issues arising from “scorched earth” litigation tactics.
David’s transactional practice emphasizes representation of real estate owners and developers, as well as contractors and design professionals, in negotiating and drafting construction and design contracts. He also represents institutional lenders in connection with complex real estate secured loans.
Prior to entering law school, David worked for three years as a sportswriter covering the NFL and the NBA. David currently serves on the firm’s Executive Committee and on the Recruiting Committee.
